Serve (DIY) Divorce - Family Court Papers

WHAT DO I DO WITH THESE DOCUMENTS THE COURT TOLD ME TO HAVE SERVED…

If you are going it alone, without an attorney (Pro Se), the court most likely gave you a Summons and Supporting documents. These documents need to be served.  Since we can't act as an attorney, we can only serve the documents you give us and we can't provide legal advise so please ensure you have the correct paperwork.

CAN I SERVE IT MYSELF?

In New York Courts, you cannot serve any documents where you are a party in the action.
Anyone over 18 who resides in New York can legally serve the papers. With that comes some responsibility.  Failing to serve or properlty complete the paperwork could set you back.

SHOULD I HIRE A PRIVATE PROCESS SERVER?

An experienced private process server is the best bet. Any errors in service could force you back to court and start over from square one. Until proper service is effected, you can’t get your matter heard. Additionally, an experienced private process server has encountered many situations and should know how to handle it.
The paperwork is equally as important. Whether served or non-served, the court needs the proper paperwork to advance your case.
Using a relative or friend can cause conflicts and ofter result in improper service or paperwork.  Also, a process server is a neutral 3rd party with no conflict or bias.
